1.1 Naxosvoyages.gr (the “Site”) and firstname.lastname@example.org email address (the “Email”) are operated by Paros Adventures k.o. Ltd, Polikarpou Smirnis, 14, Germasogeia, 4044 Limassol – CYPRUS, under the brand name Naxos Voyages, (“Paros Voyages” or “We” or “Us”).
1.2 Naxos Voyages offers to its users and visitors an online platform that facilitates the presentation and arrangement of sports and leisure activities and related services and in relation to this also provides email or messaging services, online tools and features to enable users of the Site to request and conclude booking transactions for such activities and services.
2 Agreement to terms
2.2 We reserve the right to change, modify or otherwise alter these Terms at our sole discretion at any time. The Terms applicable at your reservation are the one valid the date of the reservation. By using Naxos Voyages, You agree that the posting of new or revised Terms on the Site constitutes adequate notice to You of any and all revisions and changes. Continued use of our Service after any such changes or after explicitly accepting the new Terms upon logging into Naxos Voyages constitutes Your agreement to such changes.
2.4 In case of discrepancies between the English version and the French version of these Terms, the English version shall prevail.
3 Role of Naxos Voyages
3.1 You acknowledge and agree that Naxos Voyages is a platform that enables You to request and conclude booking transactions in respect to activities and related services listed on the Site and, consequently that Naxos Voyages is an intermediary between the User and the Service Provider and is not the one providing the booked activities and services. Naxos Voyages role is to facilitate the reservations of the Activities and Services, We do not provide, control or manage any activity listed on the Site nor related services including. We are not supplying and cannot supply such activities or services to Users and disclaims all liability arising from or related to any such Activities and Services.
3.2 By using Naxos Voyages as a platform, Service providers may offer and make available for reservation to Users, activities and services. Service providers may be either qualified or authorized providers or persons, who are entitled by law to arrange or enter into transactions of such services with Customers through Naxos Voyages. Naxos Voyages performs quality checks from time to time but is under no obligation and cannot be held liable to verify the eligibility of Service providers to offer the services presented on the Site according to the local laws and regulations that may apply and govern these types of services and disclaims all liability arising from or related to any such activities and services.
3.3 We are a party to the transactions needed for the payment of the booked activities and services, We receive the payments of the Users and We make the needed payments to the Service providers. Transactions are only binding among Naxos Voyages and Users or Naxos Voyages and the Service providers concerned, who are all solely responsible for their performance. Naxos Voyages disclaims all liability arising from any transactions between the Users and the Service providers .
4 Booking requests, cost, payment & cancellation
4.1 Users can send booking requests through Naxos Voyages by following the processes described on the Site or via Email. Booking requests through the Site can be finalize online without confirmation of Us. After Users have finalized a booking online, Naxos Voyages was the right to reject Your request within 72 hours of that request with total refund of the amount paid. The Email booking requests are finalized once both User and Naxoshave a written agreement.
4.2 The cost of the selected activity is the one found on the Site and cannot be amended, unless, before the validation of the booking, a written agreement has been made between the User and Naxos Voyages.
4.3 For reservation an advance payment of 50% is needed, rest of the amount to be paid the latest one week before the booked activity or service. If Your booking request exceeds a certain amount, You might be required to send us a proof of identity such as passport or officially accepted identity card to continue in the booking process. The reservation is valid once we trace the advance payment on our account or the User send us the transaction receipt of the payment and the User has sent us the needed information depending the activity or service. Before that moment the availability is subject to change.
4.4 If the credit card or PayPal payment before the use of the booked activity or service is not honored or revoked or You don’t proceed at the full payment one week before the activity or You don’t send us the requested documents 72 hours before the booked activity or service, this will be considered as a booking cancellation and cancellation fees will apply. When the payment is done via PayPal you also accept the terms and conditions of PayPal.
4.5 In the case that Users want to change or cancel their booking, the following cancellation policies and cancellation fees are applicable depending of the activity or booked service .
4.5.1 For the boat cruises and boat rentals the following cancellation policy will apply depending on the time-interval between the booking confirmation and the cancellation date:
a. Policy of “”Dossier’s expenses”” (150 € minimum) will be applied for bookings cancelled in time period up to 90 days prior to boat embarkation.
b. Cancellation fee of 30% of the total charter fee, for bookings cancelled within a period of 90-60 days prior to boat embarkation.
c. Cancellation fee of 50% of the total charter fee, for bookings cancelled within a period of 60-7 days prior to boat embarkation (valid also for cancellation due to not on-time full payment of the booking).
d. Cancellation fee of 100% of the total fee, for bookings cancelled in a period less than 7 days prior to boat embarkation.
In case that the boat under cancellation is re-chartered to another Charterer for the same period and under the same conditions only the dossier expenses will be charged.
In the event of cancellation of boat cruise and/or boat rental due to weather conditions meaning that boat was not allowed to cruise by port authority safety regulations, the following cancellation policy will apply:
a. Policy of “”Dossier’s expenses”” (150 € minimum) will be applied for all bookings cancelled
b. Total refund of the remaining amount.
In case weather conditions lead to the port authorities denying the boat permission to cruise to a selected itinerary by the User beyond Naxos, the company representative will inform the User of the situation offering either the same itinerary on the first available date weather permitting or a possible alternative itinerary on the original date (usually within Parian waters, weather permitting).
· Should the charterer wish to cancel the charter, the following cancellation policy will apply:
a. Cancellation Fee of 50% of the total charter hire fee
· Should the client wish to proceed with the alternative itinerary the following policy will apply:
b. Refund of the difference between the petrol costs of the original itinerary and the alternative itinerary.
4.5.2 For the other activities and services, in the event of cancellation of the booking by the User for any reason, the following cancellation policy will apply depending on the time-interval between the booking confirmation and the cancellation date:
a. Cancellation fee of 30% of the total fee will be applied for bookings cancelled in time period up to 90 days prior to the date of the booking.
b. Cancellation fee of 50% of the total fee, for bookings cancelled within a period of 90-7 days prior to the date of the booking (valid also for cancellation due to not on-time full payment of the booking).
c. Cancellation fee of 100% of the total fee, for bookings cancelled in a period less than 7 days prior to the date of the booking.
In the event that activity is not possible due to weather conditions we try to reschedule for a future date, in case no other date is available, the following cancellation policy will apply:
a. Policy of “”Dossier’s expenses”” (50 € minimum) will be applied per bookings cancelled
b. Total refund of the remaining amount.
4.6 Service providers are bonded by contract with Naxos Voyages and may not cancel bookings. If a Service provider has no choice but to cancel, he needs to inform Naxos Voyages immediately. This allows Naxos Voyages to attempt to provide Users affected by Service provider cancellations with suitable alternatives. Naxos Voyages will assist the User by attempting to arrange suitable alternative activities and/or by providing details of alternative activities offered, but in each and every case, We are under no obligation in such respect nor We are eligible to any compensation to the User other than the refund of the already paid amount.
4.7 In exceptional cases We may impose additional charges that Users must pay but that are not included in the offer’s price. Such additional charges must be expressly communicated in the respective activity offered.
4.8 Paros Voyages is not responsible for administering any requests or claims related to or arising from any charges or payments directly between Users and Service Providers, we disclaims any liability in this respect.
5 Required documents and information
5.1 Depending of the activity or service, in order for the Service provider to issue the needed documents and make the needed arrangements, You agree that as soon as you make a reservation you will send us the needed information and that in case of rentals You will be obliged to sign a contract with the Service provider. With the booking of any service and/or activity, you should inform Us for any medical condition or allergy that We and the Service provider should be aware of. In case you don’t provide us the needed information for the Service provider to be able to organize on time, the booked activity or service, it will be consider as a cancelation from Your part, and the cancelation policy will be applied.
5.1.1 For the boat cruises and sea transfers, all names as per passport and passport numbers should be provided upon booking of the boat, as well as nationalities and dates of birth, so as to prepare the Passenger List document required for permission to charter.
5.1.2 For the boat rentals, before departing with the selected boat, we have to keep record of Your id, boat driver’s license and credit card, which are absolutely required.
Damages to the boat and engines are covered by insurance company, however, according to their policy, there is a 2.500 € deductible that is on your account and will be charged directly to your credit card from the service provider.
5.1.3 For the air transfers, all names as per passport and passport numbers should be provided upon booking of the aircraft charter, as well as nationalities and dates of birth, so as to prepare the Passenger List document required for permission to charter and also needed the weight of each passenger and weight & dimensions of the baggage.
5.1.4 For all the other activities, all names as per passport should be provided upon booking of the activity, as well as nationalities and dates of birth. In case of an activity that needs a certification, you should have it with you the day of the activity.
6 Availability and booking of activities
6.1 The booking of activities depends on their availability. Information on general availability (e. g. location/region, duration, day, time of day, etc.) can be found in the individual activity descriptions on Naxosvoyages.gr but must be confirmed by Email by Us.
6.2 Commercial sale or resale. Any commercial sale or commercial resale of booked activities and services is prohibited, unless a written agreement to the contrary has been made with Naxos Voyages . For any culpable breach of the aforementioned prohibition of commercial sale or resale, Naxos Voyages shall be entitled to the payment of a reasonable contractual penalty to the User, the amount of which Naxos Voyages shall determine at its reasonable discretion and, in the event of a dispute, may be reviewed by the competent court.
7 User accounts
7.1 Upon registering and creating a Naxos Voyages account (an “Account”), You have access to the Site functionality that We may establish and maintain from time to time and in our sole discretion. We may add, delete or change some or all of the Account at any time.
7.2 As a registered User you consent to allow Naxos Voyages to contact You on Your email address or phone number with communications related to Your Account, including but not limited to requests for booking, notices and updates. You further agree to keep Your contact information updated.
7.3 You are prohibited to distribute spam and other unsolicited commercial messages through Your Account or take any other action that imposes unreasonably large data volume loads on our server and IT infrastructure. We may apply at our sole discretion anti-spam software that may delete Your messages without delivering them or prevent messages from reaching You. We expect all of our Users at all times to conduct themselves in a polite and professional manner. Personal attacks and other forms of unprofessional online behaviour may cause immediate termination of Your Account.
7.4 In case of a material breach of these Terms by You, Naxos Voyages at its sole discretion may without any liability to You terminate the access to Your Account, set inactive or delete any of your Accounts and all related information and data and bar Your access to any of such information and Naxos Voyages shall be entitled to the payment of a reasonable contractual penalty to the User, the amount of which Naxos Voyages shall determine at its reasonable discretion and, in the event of a dispute, may be reviewed by the competent court.
8 Limitation of liability
8.1 The following limitation of liability applies :
The activities and all other services displayed on the Site are provided without any guarantees, conditions or warranties as to its correctness or accuracy. To the extent permitted by law, We hereby exclude all warranties, conditions and other terms which might otherwise be implied by statute, common law or the law of equity and any liability for any direct, indirect or consequential loss, injurie or damage incurred by any User in connection with Naxos Voyages, any websites linked to it and any activity and other services posted on it including loss of income or revenue, loss of business, loss of profits or contracts, loss of anticipated savings, loss of data, and loss of goodwill, whether caused by tort (including negligence), breach of contract or otherwise, even if foreseeable. These Terms require Users to provide accurate information.
9 Release & indemnity
9.1 You agree, by using Naxos Voyages and Our Service, that any legal action, remedy or liability that you seek to obtain for actions or omissions of the Service Providers or third parties will be limited to a claim against the particular Service Provider or Service Providers or other third parties who caused you harm at the exclusion of Naxos Voyages to the fullest extent permitted by applicable law.
9.2 You agree to indemnify Naxos Voyages including its employees, officers, representatives, agents, subsidiaries, successors and connected entities against any liability, damage, loss, claim, cost or expense including legal fees and costs suffered by Naxos Voyages arising from or in connection with infringement of the terms and of the local laws. This includes any damage, loss, claim, cost or other expense suffered by Naxos Voyages relating to Your reservation of any activity or service you might, request, book or agree via our Site or by Email.
10 Transfer of rights, part-invalidity & applicable law
10.1 You agree that You may not, without Our prior written consent, transfer any of Your rights or obligations under these Terms. However, Naxos Voyages may, without Your prior written consent, transfer any of its rights or obligations under these Terms.
10.2 In case any provision or part of a provision of these Terms is found to be unlawful or otherwise invalid or unenforceable by any court or authority of competent jurisdiction, such provision or part of a provision will be struck out of these Terms and the remainder of these Terms will apply as if the offending provision or part of a provision had never been agreed.
10.3 These Terms and all matters that arise out of or relate to these Terms including but not limited to non-contractual disputes, claims and their interpretation are governed by the laws of Cyprus to the extent that such law is not overridden by the respective applicable mandatory law. Any dispute or claim that arise out of or relate to these Terms including but not limited to non-contractual disputes, claims and their interpretation are subject to the jurisdiction of the Cypriot courts. Place of jurisdiction is Limassol, Cyprus.
